37 Tex. Admin. Code § 223.5 - Contested Cases and Hearings
(a)
Contested cases, hearings and appeals will be conducted pursuant to the
Administrative Procedure Act, Texas Government Code, Chapter 2001.
(b) The commission may consider exceptions or
briefs filed within 20 days after a party's notification of a proposal for
decision. Responses are due within 15 days after exceptions are
filed.
(c) All or part of the
proceedings of a contested case will be transcribed upon the written request of
a party with cost to that party, unless the executive director provides
otherwise.
(d) Any party who
appeals a final decision must pay all preparation costs for the original or
certified copy of the record of any proceeding to be submitted to the
court.
(e) The commission may
assess transcript costs to one or more parties.
(f) The effective date of this section is
February 1, 2016.
