Utah Admin. Code R457-1-401 - Designation of Adjudicative Proceedings
(1) The Commission
designates any of the following as an informal adjudicative proceeding:
(a) any action to revoke, suspend, restrict,
place on probation or enter a reprimand as to a license;
(b) approval or denial of applications for:
(i) initial licensure;
(ii) reinstatement of a license;
and
(iii) renewal of a
license;
(c) any
proceeding conducted after the issuance of a cease and desist order;
(d) the withholding of a purse by the
Commission under Section 63N-10-313; or
(e) protests against the results of a
contest.
(2) An
individual may seek an adjudicated hearing before the Commission for the
matters listed in Subsection (1) by submitting a written request to the
Director within 30 days from the date of the action or result.
(3) Subject to the exception under Subsection
63G-4-202(3) or unless otherwise stipulated to, the Commission designates any
other adjudicative proceeding before the Commission not specifically listed in
under Subsection (1), as an informal adjudicative proceeding.
(4) The Commission may designate any
adjudicative proceeding as a formal adjudicated proceeding at the
outset.
(5) The Commission may
convert any informal adjudicative proceeding to a formal adjudicative
proceeding, and any formal adjudicative proceeding to an informal adjudicative
proceeding, in accordance with Section 63G-4-202.
