Wash. Admin. Code § 139-03-070 - Burden and standard of proof
Unless otherwise provided by law or rule:
(1) The standard of proof on all factual
issues is preponderance of the evidence.
(2) The burden of proof for the final
administrative decision of the commission rests with the commission.
(3) In any action to appeal the commission's
final administrative decision, the appealing party shall bear the burden of
proof.
(4) The burden of proof in
certification matters is governed by WAC 136-06-070(13).
