Wash. Admin. Code § 173-183-320 - Compensation schedule
(1) The
compensation schedule determines adequate compensation for unquantifiable
damages or for damages not quantifiable at a reasonable cost for persons liable
under RCW
90.48.142.
(2) Adequate compensation as determined from
the compensation schedule is derived from preexisting information of resource
vulnerability to a class of oil spilled in a particular subregion of the state
during a particular season, plus any additional information collected at the
reconnaissance stage of the spill response.
(3) Under
RCW
90.48.366, the amount of compensation
assessed under this schedule shall be:
(a) For
spills totaling one thousand gallons or more in any one event, no less than
three dollars per gallon of oil spilled and no greater than three hundred
dollars per gallon of oil spilled; and
(b) For spills totaling less than one
thousand gallons in any one event, no less than one dollar per gallon of oil
spilled and no greater than one hundred dollars per gallon of oil
spilled.
