W. Va. Code R. § 14-2-10 - Restrictions
10.1. A certificate
holder may not establish a pharmacy in an optometric office or sell oral
pharmaceutical agents prescribed in treatment unless there is a licensed
pharmacist on staff and present when the prescriptions are filled.
10.1.a. The certificate holder may also pass
on to the patient a charge for any medications provided to initiate treatment
which reflects only the actual amount paid by the optometrist for the agents.
In no event shall an optometrist increase the cost of the pharmaceutical agent
beyond the wholesale cost of that medication.
10.2. The certificate holder practicing under
the authority of this rule shall be held to the same standards of care as that
of other health care practitioners providing similar services.
