W. Va. Code R. § 142-8-4 - Application For Certificate Of Authority Or License; Contents Of Application
4.1. No
person shall sell, offer for sale, make available or be a provider of a preneed
funeral contract until such time as he has received a certificate of authority
from the Department. Employees or agents of persons holding a certificate of
authority and who are involved in actually selling preneed funeral contracts
must have a license issued by the Department. No person shall be eligible to
obtain a license to sell preneed funeral contracts unless he or she also holds
a certificate of authority or is employed by the holder of a certificate of
authority.
4.2. No person, other
than a bank, trust company, savings and loan association or other financial
institution as provided in W. Va. Code '47-14-3(a),
may act as a trustee with respect to funds paid on preneed funeral contracts
unless he has procured a certificate of authority.
4.3. The Department shall prescribe the
necessary forms for applying for a certificate of authority or license. These
forms shall be used by all applicants.
4.4. Application for the renewal of a
certificate of authority or license for the year commencing January 1, 1988,
shall be submitted by March 1, 1988. Applicants holding certificates or
licenses for 1987 who submit timely renewal applications may continue to do
business under the previous certificate or license until the renewal is granted
or refused by the Department. In all subsequent years, commencing with November
1, 1988, all such renewal applications shall be due by November 1. Commencing
with December 31, 1988, all such certificates of authority and licenses will
expire on December 31 of each year.
