W. Va. Code R. § 142-8-5 - Initial Examinations
5.1.
Examination of the records of a holder of a certificate of authority by the
Department, or at its direction, may occur with or without advance notice of
such examination.
5.2. Holders of
certificates of authority shall make all books, records, and other information
relating to preneed funeral contracts available during regular business
hours.
5.3. The Department shall be
entitled to charge fees and expenses to a holder of a certificate of authority
for an initial examination within a reporting year if the examination reveals
or confirms any violation of the provisions of the Preneed Burial Contracts Act
or this rule. Fees and expenses for such examination shall be assessed as
provided in section 6.2 of this rule.
5.4. Failure to provide necessary records or
submit to any examination or pay the expenses assessed therefore shall result
in suspension or revocation of the certificate of authority.
