W. Va. Code R. § 170-6-5 - Firm Fixed Pricing
5.1. All
contracts should be entered into for a firm, fixed price per unit of goods or
service. In such cases where the nature of the procurement prohibits a firm,
fixed price, a detailed written justification must be included in the
file.
