W. Va. Code R. § 53-3-10 - Exercising the Right of Eminent Domain
10.1. The
Authority may exercise its right of eminent domain only after the acquiring
entity has complied with this rule, and upon the affirmative vote of a majority
of all of the members of the Board.
10.2. The Authority may exercise the right of
eminent domain only in a manner consistent with the provisions of the West
Virginia Constitution Article III, '9 and in accordance with the applicable
provisions of W. Va. Code ''5D-1-1 et seq., 54-1-1 et seq., 54-2-1 et seq. and
54-3-1 et seq.
