W. Va. Code R. § 64-31-13 - Penalties

13.1. Director's Authority

13.1.1. The director is authorized to suspend or revoke a birthing center license according to the provisions of Chapter 16, Article 2E, Section 2 of the West Virginia Code of 1931, as amended, if he or she finds upon inspection that there has been a substantial failure to comply with the provisions of these rules and regulations or with the laws of this state or with any order or final decision of the director.

13.2. The director may refuse to grant a license if he or she finds that the applicant has attempted to obtain the license by means of fraud or deceit.

13.3. The director may suspend or revoke a license if he or she finds that the license has been obtained by means of fraud or deceit.

13.4. When the director takes action pursuant to the suspension or revocation of a license issued under these rules and regulations, he or she shall comply with the requirements and procedures specified by Chapter 16, Article 2E, Section 2 of the West Virginia Code of 1931, as amended.
