W. Va. Code R. § 64-31-14 - Administrative Due Process
14.1. An
applicant for a license or a licensee or any other person aggrieved by an order
or other action by the director pursuant to these regulations or the laws of
this State shall have the opportunity for a hearing by the director, upon
written request to the director in a manner prescribed in and by the
aforementioned Rules of Procedure for Contested Case Hearings and Declaratory
Rulings (1983) promulgated by the board of health. The aforementioned rules of
procedure are incorporated herein by reference.
14.2. A hearing pursuant to this section
shall be conducted in accordance with the pertinent provisions of Chapter 29A,
Article 5 of the West Virginia Code of 1931, as amended, and the aforementioned
Rules of Procedure for Contested Case Hearings and Declaratory Rulings
(1983).
14.3. The director's order
shall be final unless vacated or modified by judicial review in accordance with
the provisions of the law of this State.
