W. Va. Code R. § 64-31-3 - Application and Enforcement
3.1.
Application - These legislative rules shall apply to any person, partnership,
association or corporation and any local governmental unit or any division,
department, board or agency thereof establishing, conducting, managing or
operating a birthing center.
3.2.
Exceptions
3.2.1. A birthing service or
center operated as a service within a hospital shall be licensed under hospital
licensure regulations as promulgated under Chapter 16, Article 5B of the West
Virginia Code of 1931, as amended.
3.3. Enforcement - The enforcement of these
legislative rules is vested with the director of the West Virginia department
of health or his or her lawful designee.
