W. Va. Code R. § 64-85-1 - General
1.1. Scope. -- This
legislative rule prescribes specific standards and procedures to provide for
the health, safety, and protection of the rights and dignity of individuals
served by alzheimer's/dementia special care units and programs. This rule shall
be read in conjunction with W. Va. Code §
16-5R-1 et
seq. The W. Va. Code is available in public libraries and on the Legislature's
web page, http://www.legis.state.wv.us/.
1.2. Authority. -- W. Va.. Code §§
16-1-4 and
16-5R-5(a).
1.3. Filing Date. --
April 12, 2006.
1.4. Effective
Date. -- May 1, 2006.
1.5.
Applicability. -- This rule applies to facilities which advertise, market or
otherwise promote the facility as providing special care units or programs for
persons who have alzheimer's disease or a related dementia.
1.6. Enforcement. -- This rule is enforced by
the secretary of the West Virginia department of health and human resources or
his or her lawful designee.
