Alabama Legislative Black Caucus v. Alabama

While Obergefell grabbed the headlines, there were plenty of other cases where the Court applied Constitutional principles to resolve disputes. In Alabama Legislative Black Caucus v. Alabama, the same Justices that constituted the Obergefell majority ordered a new trial on the legality of Alabama’s 2012 voter redistricting plan. [Read our Preview here.] The Supreme Court ordered the District Court upon retrial to apply strict scrutiny to the plaintiff’s claims of impermissible racial gerrymandering for each voting district, instead of the re-districting plan as a whole. The majority also seemed to suggest that some of Alabam’s new districts fell outside of Constitutional norms.
