Direct and unambiguous elements specifically mentioned in an oral or written contract. Express terms in a contract are significantly different from implied terms, where existence of a condition is assumed by the circumstances or inferred from conduct of the parties to a contract. Express contract is direct and explicitly stated and nothing is left to infer, as opposed to an implied contract. (See also: Express authority; Express warranty; Express contract)
