A Congressional act that contains disparate statutory provisions which were enacted to align reconciliation bills with instructions in a budget resolution. Congress passed Omnibus Budget Reconciliation Acts in 1981, 1982, 1983, 1986, 1987 (also referred to as the Revenue Reconciliation Act of 1987), 1989, 1990, and 1993. One of the most well-known provisions of the OBRAs is the revision of the federal standards for nursing home care in the 1987 OBRA. This Act established minimum standards of care and rights for people living in nursing home facilities. For example, 42 CFR § 483.15(a)(2), a regulation promulgated pursuant to the 1987 OBRA, mandated that “[t]he [nursing home] facility must [n]ot request or require residents or potential residents to waive their rights.”
