Under the Employee Retirement Income Security Act ("ERISA"), a judgment, decree, or order regarding child support and coverage under a group health plan that (1) assigns the right to receive benefits under a group health plan and (2) is made pursuant to either a state's domestic relations law or the Social Security Act, 42 U.S.C. § 1396g–1. 29 U.S.C. § 1169(a)(2). A qualified medical child support order ("QMCSO") allows a non-employee, custodial parent to obtain health coverage for his or her child from the employee parent's group health plan.
