§ 430.47 Effective dates of final rules.
(a) A final rule exempting a State standard from Federal preemption will be effective:
(1) Upon publication in theFederal Register if the Secretary determines that such rule is needed to meet an “energy emergency condition or water emergency condition (in the case of faucets, showerheads, water closets, and urinals)” within the State.
(2) Three years after such rule is published in theFederal Register; or
(3) Five years after such rule is published in theFederal Register if the Secretary determines that such additional time is necessary due to the burdens of retooling, redesign or distribution.
(b) A final rule withdrawing a rule exempting a State standard will be effective upon publication in theFederal Register.

      Reopening of the public comment period and announcement of public meeting.
      Comments: The comment period for the NOPR for the Conversion Factor for Test Procedures for Consumer and Certain Commercial Water Heaters published on April 14, 2015 (80 FR 20116), is reopened. DOE will accept comments, data, and information regarding this NOPR before and after the public meeting, but no later than June 15, 2015. Meeting: DOE will hold a public meeting on Thursday, May 28, 2015 from 10:00 a.m. to 4:00 p.m., in Washington, DC. The meeting will also be broadcast as a webinar.
