Effective date: These regulations are effective July 31, 2017. The incorporation by reference of certain publications listed in these regulations is approved by the Director of the Federal Register as of July 31, 2017. Comment due date: We will accept comments on or before August 30, 2017. We will consider the comments received and may conduct additional rulemaking based on the comments. 34 CFR Parts 75 and 77 The Secretary is issuing this rule in order to better align the regulations with the definition of “evidence-based” in the statutory authority. These changes mean that all competitive grant programs in the Department can continue to use the same provisions for evidence-based grant-making.

Executive Order 13559 amended Executive Order 13279 to clarify those principles and add certain protections for beneficiaries of Federal social service programs.

These regulations are effective December 2, 2015. 2 CFR Part 3474 The Secretary adopts as final regulations of the Department the interim final regulations that were published on December 19, 2014. This action adopts the OMB guidance in title 2 of the CFR as final regulations of the Department. The Secretary amends the interim final regulations to correct technical errors contained in the amendments.

We must receive your comments on or before October 5, 2015. 2 CFR Part 3474 The Secretary proposes to amend the Education Department General Administrative Regulations (EDGAR) governing direct grant programs and State-administered programs as they relate to faith-based organizations. The Secretary also proposes to amend the regulations governing uniform administrative requirements, cost principles, and audit requirements for Federal awards. The amendments are designed to implement Executive Order 13279, as amended by Executive Order 13559. This waiver and extension enables the currently funded National Interpreter Education Center for the training of interpreters for individuals who are deaf or hard of hearing and individuals who are deaf-blind (National Center) to receive funding through September 30, 2016.

We must receive your comments on or before March 12, 2015. 34 CFR Part 75 For the Native Hawaiian Career and Technical Education Program (NHCTEP), the Secretary proposes to waive the requirements that generally prohibit project period extensions involving the obligation of additional Federal funds and extend the project periods of the seven current NHCTEP grants for up to an additional 24 months. This proposed waiver and extension would allow the seven current NHCTEP grantees to seek continuation awards annually through fiscal year (FY) 2016 and possibly through FY 2017.

In this document, the Department amends EDGAR to add a definition of “What Works Clearinghouse Evidence Standards” (WWC Evidence Standards) in our regulations to standardize references to this term. In addition, the Department amends the definition of “large sample” in our regulation. We also make technical edits to our regulations to improve the consistency and clarity of the regulations. Finally, we redesignate a section of our regulations and include in that redesignated section an additional provision that allows the Secretary to give special consideration to projects supported by evidence of promise.

For non-Federal entities that are nonprofit organizations or institutions of higher education (IHEs), there is a one-year grace period for implementation of the procurement standards in 2 CFR 200.317 through 200.326. As will be detailed in the 2015 OMB Compliance Supplement, non-Federal entities choosing to delay implementation for the procurement standards will need to specify in their documented policies and procedures that they continue to comply with OMB circular A-110 for one additional fiscal year which begins after December 26, 2014. This rule is necessary in order to incorporate into regulation and thus bring into effect the Uniform Guidance as required by OMB. Implementation of this guidance will reduce administrative burden and risk of waste, fraud, and abuse for the approximately $600 billion per year awarded in Federal financial assistance. These amendments will allow the Department to be more effective and efficient when selecting grantees in discretionary grant competitions, provide higher-quality data to the Congress and the public, and better focus applicants on the goals and objectives of the programs to which they apply for grants.

We must receive your comments on or before July 11, 2013. 34 CFR Part 75 and Chapter III These proposed waivers and extensions of project periods would affect two sets of grantees under the American Indian Vocational Rehabilitation Services (AIVRS) Program in the Rehabilitation Services Administration (RSA): eight grantees with 60-month projects initially funded in fiscal year (FY) 2007 (72 FR 11851) and twenty-four grantees with 60-month projects initially funded in FY 2008 (73 FR 6491). For FY 2013, the Secretary proposes to waive the regulations that generally limit project periods to 60 months and that restrict project period extensions involving the obligation of additional Federal funds. The Secretary proposes these actions in order to extend the 60-month projects for the grants initially funded in FY 2007 for a seventh year, and the grants initially funded in FY 2008 for a sixth year. The 32 AIVRS grants would be extended through September 30, 2014. The proposed waivers and extensions would enable the 32 grantees to request funds and continue to receive Federal funding beyond September 30, 2013, when the project period ends. The grantees must meet all of the AIVRS program and other applicable requirements while receiving funds under this program. Further, if the proposed waivers and extensions are made final, RSA would not announce a new competition in FY 2013 or make new awards in FY 2013.
