Bachpan Bachao Andolan v. Union of India & Others

In Bachpan Bachao Andolan v. Union of India & Others, the non-governmental organization Bachpan Bachao Andolan petitioned the Supreme Court of India to address the use of child performers in traveling circuses. A study revealed that children were being trafficked from Nepal or taken from their homes, forced to work as child laborers, and subjected to mental, physical, and sexual abuse.

Charter of Human Rights and Responsibilities Act (Victoria)

The Charter of Human Rights and Responsibilities Act (Victoria) aims to protect and promote the human rights set out in Part 2, including property rights and freedom from forced work (slavery), as well as the right to enjoy those human rights without discrimination. With respect to any proposed new law, the member of Parliament proposing the law must prepare a 'statement of compatibility', which must examine the proposed law’s compatibility (or incompatibility) with the human rights protected in the Charter.

Combating of Trafficking in Persons Act (Act 7 of 2023)

The Combating of Trafficking in Persons Act (Act 7 of 2023) repeals and replaces the Combating of Trafficking in Persons Act of 2005 while retaining the core prohibition on all forms of human trafficking. Section 2 defines trafficking through the recruitment, transport, transfer, harboring, or receipt of a person for exploitation, using force, coercion, deception, abuse of power, or payments made to a person controlling the victim.

Criminal Code Chapter 22: Trafficking in Persons

Art. 181 defines trafficking in persons as the “recruiting, transporting, transferring, harboring, or receiving a person” for the purposes of exploitation by deception, abuse of trust, or use of violence, or threat of such violence.  Trafficking in persons is punishable by imprisonment for a term of three to seven years and for a term of up to 15 years if committed in aggravating circumstances, such as, knowingly against a pregnant woman or a minor, or with the removal of the person outside of the country, among others.  Art.

Doe v. Penzato

Plaintiff Jane Doe (“Doe”) filed a lawsuit under a pseudonym and alleged 23 causes of action including human trafficking, sexual battery, forced labor and involuntary servitude against Defendants Mr. and Mrs. Penzato. Mrs. Penzato had offered Doe $1,500 per month, free room and board, and transportation to the United States in exchange for child care and housekeeping services. Doe accepted the offer and moved to San Francisco, California.

Modern Slavery Act (New South Wales)
