ArbeitnehmerInnenschutzgesetz (ASchG) (Occupational Health and Safety Act)

The legislation generally serves to protect of all male and female employees. Specifically targeting the protection of women, Article 6(4) states that female employees shall not perform work which, by its very nature,  may hold specific dangers for women or alternatively, women may only perform such work with certain restrictions or measures suitable to prevent such risks. The Federal Ministry of Labor shall specify those works in a separate regulation (Article 18 no. 2).

Arizona Revised Statutes § 41-1612 Community Treatment for Incarcerated Women

Arizona Revised Statutes § 41-1612 establishes a community treatment program for women who give birth while incarcerated, allowing eligible mothers to live with their children in a nonprofit-operated community treatment center as an alternative to incarceration, subject to public safety and available funding. The statute requires the department of corrections to adopt rules governing eligibility and participation and limits eligibility to women scheduled for release within five years.

Employment Act of The Bahamas

The Employment Act establishes the rights and obligations of employers and employees in The Bahamas, specifically related to hours of work, overtime, leave, redundancy payments, notice of termination, summary and unfair dismissal, child labor, and wages. This Act prohibits workplace discrimination on the basis of sex, among other criteria, and requires employers to provide equal pay for substantially similar work.

The plaintiff lost a portion of her salary because she could not work overtime during her pregnancy. In deciding whether she was entitled to maternity leave payments, the Austrian Supreme Court considered the overtime work element rather than regular wage elements. The Supreme Court ruled in favor of the plaintiff, causing a general improvement in the financial position of Austrian maternity benefit recipients.

Louisiana Revised Statutes § 23:342 Pregnancy Discrimination

Louisiana Revised Statutes § 23:342 prohibits discrimination against pregnant persons. Employers can not refuse to promote a pregnant person because of their pregnancy status, can not deny benefits on the basis of pregnancy, and in the case of organizations with reduced work for disabled persons, employers can not refuse to transfer a pregnant person to those reduced work positions.

Massachusetts General Laws Chapter 112 Section 12L Personal Decision Regarding Pregnancy

Massachusetts General Laws Chapter 112, § 12L protects an individual’s right to make personal decisions about contraception and pregnancy. This includes their choices for preventing, starting, continuing, or terminating a pregnancy. The statute prohibits the state or its subdivisions from interfering with these choices, and also bars restrictions on medically appropriate abortion methods or the manner in which such abortion care is provided.
