In this case, the petitioner submitted a marriage registration stating that each spouse would retain their own surname (“the husband shall use his surname, the wife shall use her surname”). The registration was rejected on the grounds that it violated Article 750 of the Civil Code and Article 74(1) of the Family Register Act. The petitioner argued that this rejection was unconstitutional, violating Articles 14(1), 24, and 98(2) of the Constitution, and filed a special appeal. The Supreme Court dismissed the appeal, holding that in light of relevant precedents, Article 750 of the Civil Code and Article 74(1) of the Family Register Act are not unconstitutional.

抗告人は、婚姻届に「夫は夫の氏、妻は妻の氏を称する」と記載したが、民法750条および戸籍法74条1号に違反するとして不受理処分を受けた。抗告人は、この処分が不当であり、両規定が憲法14条1項、24条、98条2項に違反すると主張し、特別抗告を申し立てた。最高裁判所は、民法750条および戸籍法74条1号について、関連判例を踏まえると憲法違反は認められないと判断し、抗告を棄却した。
