Reiwa 2 (Kú) No. 638 Special Appeal Against the Decision to Dismiss an Appeal Concerning the Rejection of a Petition for Change of Legal Gender
The petitioner was legally registered as male and underwent gender affirmation surgery. She then filed a petition under Article 3(1) of the Special Act on Gender Identity Disorder to change her legal gender marker. However, the petition was dismissed because she did not meet the requirement of Article 3(1)(iii) of the Act, which mandates that the applicant must not have any minor children at the time of application. The petitioner argued that this provision violated Articles 13 and 14(1) of the Constitution and filed a special appeal. The Supreme Court dismissed the appeal, holding that it was clear, in light of existing precedent, that the requirement in question did not violate the Constitution.
抗告人は性同一性障害者の性別の取扱いの特例に関する法律(特例法)3条1項に基づき性別の取扱いの変更を申し立てたが,同項3号(「現に未成年の子がいないこと」)の要件を満たさないとして申立てが却下された。抗告人は,同号が憲法13条・14条1項に違反するとして特別抗告を行った。最高裁判所は,既判例の趣旨に照らして当該要件が合理性を欠くものとはいえず違憲でもないとして,特別抗告を棄 した。
