The European Court of Human Rights (ECHR) ruled in this case on the French authorities' refusal to allow three transgender people to change their gender on their birth certificate without having undergone a sterilizing surgery. The Court ruled that the rejection of their request, based on the criterion of the irreversibility of the physical transformation through a sterilization surgery, was a violation of the right to the protection of privacy under Article 8 of the European Convention on Human Rights. The ECHR ruled that France had failed in its positive obligation to guarantee these individuals' right to privacy by imposing a condition deemed excessive and discriminatory for the change of gender in civil status records.
Dans cette affaire, la Cour européenne des droits de l'homme (CEDH) a statué sur le refus des autorités françaises d'autoriser trois personnes transgenres à changer la mention de leur sexe sur leur acte de naissance sans subir une opération stérilisante. La Cour a conclu que le rejet de leur demande, basé sur le critère de l'irréversibilité de la transformation physique par une opération stérilisante, constitue une violation du droit au respect de la vie privée, en vertu de l'article 8 de la Convention européenne des droits de l'homme. La CEDH a jugé que la France avait manqué à son obligation positive de garantir le droit au respect de la vie privée de ces individus en imposant une condition jugée excessive et discriminatoire pour le changement de mention de sexe à l'état civil.
