The Political Constitution of the Republic of Chile provides a fundamental legal framework to ensure equality before the law, prohibit arbitrary discrimination, and protect personal integrity and honor. Article 19(1) guarantees the right to life and to physical and psychological integrity, expressly stating that the law protects the life of the unborn. Article 19(2) affirms that men and women are equal before the law, prohibits privileges for individuals or groups, and forbids arbitrary distinctions established by law or authority. Article 19(4) protects personal integrity and honor. Article 19(10) establishes equal opportunities in access to education and culture. Article 19(16) guarantees equality in labor rights, including the type, quality, and quantity of work performed and the remuneration received. In addition, Article 16 prohibits employment discrimination not based on personal capacity or suitability, except where Chilean nationality or age limits are required by law for specific positions.
La Constitución Política de la República de Chile establece un marco jurídico esencial para la igualdad y la protección de los derechos fundamentales. El artículo 19, numeral 1, garantiza el derecho a la vida y a la integridad física y psíquica, disponiendo que la ley protege la vida del que está por nacer. El artículo 19, numeral 2, asegura que hombres y mujeres son iguales ante la ley, prohíbe privilegios de personas o grupos, y proscribe toda discriminación arbitraria que pueda establecer la ley o la autoridad. El artículo 19, numeral 4, protege la honra y la integridad personal. El artículo 19, numeral 10, reconoce el derecho a la igualdad de oportunidades en el acceso a la educación y a la cultura. El artículo 19, numeral 16, garantiza la igualdad de derechos laborales, abarcando tipo, calidad y cantidad del trabajo, así como la remuneración. Por su parte, el artículo 16 prohíbe toda discriminación laboral que no se funde en la capacidad o idoneidad personal, salvo en los casos en que la ley requiera nacionalidad chilena o fije límites de edad para determinadas funciones.
