Act on Self-Determination with Regard to Gender Registration (2024)

Germany’s 2024 Self-Determination Act introduces a streamlined, administrative process for individuals to change their gender marker and first names in the civil registry based on self-identification, without requiring medical intervention, expert opinions, or court orders. The law strengthens the right to personal autonomy and aims to ensure dignity and respect for gender-diverse individuals, including trans, non-binary, and intersex persons. Declarations must be registered three months in advance and are subject to a one-year waiting period between changes. Special procedures apply to minors and legally incapacitated adults, requiring parental consent, court approval, and documented counseling. The Act prohibits the unauthorized disclosure of previous gender entries and names, with fines of up to €10,000 for intentional violations. It guarantees the right to update official documents and records, ensures access to gendered spaces remains subject to private discretion, and confirms that gender-specific laws related to biological functions (e.g., pregnancy or sperm donation) apply regardless of legal gender. Gender quotas in public bodies are determined by the registry entry at the time of appointment. The law entered into force in phases beginning August 1, 2024.
