17 AAC 45.252 - Holdover
(a) Unless the lease, permit, or concession
provides otherwise, if the department has not directed the lessee, permittee,
or concessionaire to vacate the premises upon expiration of the lease, permit,
or concession, then if the lessee, permittee, or concessionaire continues to
occupy the premises in holdover after the expiration of a lease, permit, or
concession, the holdover ends on the earliest of the following:
(1) the date on which the department and the
lessee, permittee, or concessionaire execute
(A) a term extension for the lease, permit,
or concession; or
(B) a lease,
permit, or concession for the premises;
(2) the date on which the department or the
lessee, permittee, or concessionaire terminates the holdover upon not less than
30 days' notice;
(3) the 180th day
after the expiration of the lease, permit, or concession.
(b) The department may extend a holdover
under this section for not more than an additional 180 days upon a written
finding of good cause.
