18 AAC 87.220 - Public notice procedures
(a) The department
will give notice to the public that a draft permit has been prepared under
18 AAC 87.210.
(b) In a public notice, the department will
allow at least 30 days for public comment on the draft permit.
(c) The department will give public notice of
a draft permit
(1) by sending a copy of the
notice to the municipality with jurisdiction over the proposed facility site;
and
(2) by publishing a notice in a
daily or weekly newspaper within the area affected by the facility or
activity.
(d) A public
notice issued under this section must contain at least the following
information:
(1) the name and address of the
office processing the permit action for which notice is being given and where
comments may be submitted;
(2) the
name and address of the permittee or permit applicant;
(3) a brief description of the proposed
facility;
(4) a brief description
of the location of the proposed facility;
(5) the name, address, and telephone number
of a person from whom interested persons may obtain further information,
including copies of the draft permit and the application;
(6) a brief description of the comment
procedures required by (e) of this section; and
(7) any additional information that the
department considers necessary or proper.
(e) During the public comment period, any
interested person may submit written comments on the draft permit. The
department will consider all comments in making the final decision and will
issue a responsiveness summary that includes responses to all comments
received. The department will make the summary available to the
public.
