2 AAC 35.134 - Time of action
(a) When a person is required to make a
filing with the division, including a notice of appeal, or with the
commissioner of administration within a certain time period under AS 39.35 or
this chapter, the effective date of that filing is the day it is received by
the division or the commissioner, as appropriate, or, if mailed to the
appropriate entity, the day it is postmarked.
(b) If a mailed filing has an illegible
postmark or an undated postmark, the postmark date is rebuttably presumed to be
five working days before the day the filing is received by the division or the
commissioner of administration.
(c)
If a person makes a filing required to be made to the division or to the
commissioner of administration to the person's employer instead, and the
employer forwards the filing to the division or to the commissioner, the
effective date of the filing is the date that it is received by the division or
the commissioner, or the date of the postmark or other proof of sending by the
employer.
