7 AAC 40.130 - Non-institutional residency

(a) To be eligible for assistance, an applicant may not be a resident of
(1) a public institution, except a long-term care facility or hospital as provided in 7 AAC 40.385 or 7 AAC 40.390;
(2) a prison or jail;
(3) an Alaska Pioneers' Home, except as provided in 7 AAC 40.385; or
(4) a public or private institution for mental disease, except as provided in 7 AAC 40.385.
(b) Assistance will be provided to an otherwise eligible applicant for the month in which the applicant is admitted to an institution listed in (a) of this section, or for the month in which the applicant is discharged, if the applicant resides outside of the institution for at least one day of the month.
(c) In this section, "public institution" does not include a publicly operated community residence under 20 CFR 416.211(c).
