7 AAC 45.295 - Public assistance households
(a) In determining
ATAP eligibility, the department will disregard the resources of an individual
who is
(1) actually receiving adult public
assistance (APA) or supplemental security income (SSI) benefits;
(2) living in the home of an applicant for
ATAP benefits; and
(3) considered
legally responsible for either the dependent child or the caretaker relative
under state law, including this chapter.
(b) If an individual whose resources would be
disregarded under (a) of this section, is eligible to receive APA or SSI
benefits but has not yet received a payment, the department will regard the
resources of that individual as available to the assistance unit.
(c) If an applicant or recipient notifies the
department that an individual whose resources have not been disregarded under
(a) of this section is now receiving APA or SSI payments, the department will
redetermine the assistance unit's resource eligibility, disregarding that
individual's resources.
(d) If the
department or the federal government considers a resource in determining that a
member of an economic unit is eligible for APA or SSI benefits, the department
will not consider that resource in determining the eligibility of the
assistance unit for ATAP benefits. The department will, however, prorate all
jointly held resources as described in
7
AAC 45.310(c).
