7 AAC 72.150 - Patient records
(a) In addition to complying with
7 AAC 12.770, as adopted by reference in
7 AAC 72.012, for each patient, a facility shall
maintain a clinical record with forms that document the facility's use of the
emergency examination or the evaluation procedure set out in
7 AAC 72.220 -
7 AAC 72.260.
(b) The facility shall safeguard patient
records, including electronic records, against loss, defacement, tampering, and
use by unauthorized persons. Information from patient records, including
electronic records, may be released only in accordance with
AS
47.30.845 and (c) of this section.
(c) For a patient being treated for alcohol
or drug abuse in a facility that receives federal assistance as described in
42 C.F.R.
2.12(b), the facility may
disclose information from that patient's records only as allowed under 42
C.F.R. Part 2, including use of the consent form required under
42 C.F.R.
2.31.
(d) Patient records that are required to be
submitted to the department are subject to the applicable requirements of 7 AAC
85.
