8 AAC 45.094 - Predisposing conditions for certain firefighters
The provisions of AS 23.30.121(b)(1)(A) and (B) do not apply to a firefighter who develops a cardiovascular or lung condition and has a history of tobacco product exposure. For purposes of this section, tobacco product exposure is
(1)
significant direct tobacco product use through smoking, inhaling, or chewing
tobacco, significant exposure to environmental tobacco smoke through secondhand
smoke, or significant tobacco production or handling; or
(2) a cotinine level, measured in the
individual's blood, of 15 or more nanograms per milliliter of blood serum,
regardless of the medical history documented by the firefighter and
physician.
