Ariz. Admin. Code § R11-3-812 - Bonding Pool
A. A
responsible party may satisfy the financial assurance requirements in the Act
and this Chapter by providing the Inspector with a certificate of participation
in a reclamation bond pool.
B. The
responsible party shall ensure the certificate of participation:
1. Is an indemnity agreement in a sum certain
payable to the State of Arizona;
2.
Is executed by a surety bond pool organization of which the responsible party
is a member; and
3. Is supported by
the performance guarantee of a corporation licensed to do business as a surety
in Arizona.
