Ariz. Admin. Code § R12-15-1225 - Emergency Repairs
A. The Director
shall use monies from the dam repair fund, established under A.R.S. §
45-1212.01 to
employ any remedial measure necessary to protect human life and property
resulting from a condition that threatens the safety of a dam if the dam owner
is unable or unwilling to take action and there is not sufficient time to issue
and enforce an order.
B. The deputy
director may authorize an expenditure not to exceed $10,000 from the dam repair
fund for remedial measures under A.R.S. §
45-1212.
The expenditure of any additional funds shall be approved by the
Director.
C. The Director shall
hold a lien against all property of the owner in accordance with A.R.S. §
45-1212.
