Ariz. Admin. Code § R18-13-1212 - [Effective 12/3/2025] Registration of Outdoor Used Tire Sites; Fee
A. A person shall not store 100 or more used
tires outdoors until the person registers with the Department. A person that
stores 100 or more used tires outdoors shall pay an initial registration fee of
$1,800 within 30 days of invoice receipt. The person shall register on a form
approved by the Department that includes a statement that the site is in
compliance with A.R.S. §
49-762.07(F) and
A.R.S. Title 44, Chapter 9, Article 8, as applicable.
B. A $1,500 registration fee shall be paid
annually thereafter within 30 days of invoice receipt.
C. For the purposes of this Section:
1. "Used tire" means any tire which has been
used for more than one day on a motor vehicle.
2. "Outdoors" means other than inside a
building with a weatherproof roof.
D. Beginning July 1, 2026, the Director shall
adjust the fee amounts in subsections (A) and (B) of this Section annually by
the following method, except that no adjustment in any year shall exceed four
percent of the fee amount of the preceding year:
1. Multiply the amount by the October CPI for
the most recent year and then divide by the October CPI for the year 2024. The
October CPI for any year is the Consumer Price Index for All Urban Consumers,
Phoenix-Mesa-Scottsdale, AZ, all items, published by the United States
Department of Labor at www.bls.gov/cpi/regional-resources.htm,
for October of that year.
2. Round
the result from subsection (D)(1) to the nearest cent. ADEQ shall post the new
amounts on its webpage and install them in the billing software as soon as
practicable.
