Ariz. Admin. Code § R18-9-A208 - Compliance Schedule
A. A
permittee shall follow the compliance schedule established in the individual
permit.
1. If a compliance schedule provides
that an action is required more than one year after the date of permit
issuance, the schedule shall establish interim requirements and dates for their
achievement.
2. If the time
necessary for completion of an interim requirement is more than one year and is
not readily divisible into stages for completion, the permit shall contain
interim dates for submission of reports on progress toward completion of the
interim requirements and shall indicate a projected completion date.
3. Unless otherwise specified in the permit,
within 30 days after the applicable date specified in a compliance schedule, a
permittee shall submit to the Department a report documenting that the required
action was taken within the time specified.
4. After reviewing the compliance schedule
activity the Director may amend the Aquifer Protection Permit, based on changed
circumstances relating to the required action.
B. The Department shall consider all of the
following factors when setting the compliance schedule requirements:
1. The character and impact of the
discharge,
2. The nature of
construction or activity required by the permit,
3. The number of persons affected or
potentially affected by the discharge,
4. The current state of treatment technology,
and
5. The age of the
facility.
C. For a new
facility, the Department shall not defer to a compliance schedule any
requirement necessary to satisfy the criteria under A.R.S. §
49-243(B).
