Ariz. Admin. Code § R19-3-556 - Resolution of Solicitation and Contract Award Protests
A. The procurement officer has the authority
to resolve a protest.
B. The
procurement officer shall issue a written decision within 14 days after a
protest has been filed under
R19-3-554 .
The decision of the procurement officer shall contain the factual and legal
basis for the decision and a statement that the decision of the Lottery may be
appealed as an appealable agency action under A.R.S. Title 41, Chapter 6,
Article 10 within 30 days from receipt of the decision.
C. The procurement officer shall furnish the
decision to the interested party, by certified mail, return receipt requested,
or by any other method that provides evidence of receipt and provide a copy to
the Director.
D. The time limit for
decisions under subsection (B) may be extended for good cause by a written
determination. The extension shall not exceed an additional 30 days. The
procurement officer shall notify the interested party in writing that the time
for the issuance of a decision has been extended and the date by which a
decision shall be issued.
E. If the
procurement officer fails to issue a decision within the time limits set forth
in this Article, the interested party may proceed as if the procurement officer
had issued an adverse decision.
