Ariz. Admin. Code § R2-15-307 - Authority for Transfer of Materials
A. The Surplus Property Administrator shall
determine whether an entity is eligible to acquire federal or state surplus
materials. Eligibility for federal surplus materials is determined in
accordance with federal law. The determination of whether an entity is eligible
for state surplus materials is based on whether the entity:
1. Is eligible to receive federal surplus
materials, or
2. Is a federal
income tax exempt non-profit entity that is a health or educational
organization as defined in federal law that has at least one full-time salaried
employee and demonstrates a public benefit for receiving state surplus
materials.
B. A state
governmental unit shall not acquire federal or state surplus materials without
the approval of the Surplus Property Administrator.
