Ariz. Admin. Code § R2-8-513.02 - Termination Date
For the purpose of an Irrevocable PDA, the date an Eligible Member is considered terminated from an Employer is:
1. For an Eligible Member terminating
employment, the Eligible Member's last pay period end date with that
Employer;
2. For an Eligible Member
on military call-up who does not return to the same Employer:
a. 90 days from the date of separation
fromlmilitary call-up;
b. 90 days
from the date released from the hospital, if injured while on military call-up;
or
c. The date the Eligible Member
has been hospitalized for two years for injuries sustained as a result of
participating in a military call-up.
d.
The date of the member's death as a result of
participating in a Presidential Call-up;
3. For an Eligible Member on leave of absence
without pay who does not return to the same Employer, the date the Employer
required the Eligible Member to return to work;
4. For an Eligible Member who is unable to
work because of a disability, the later of:
a.
The date the Eligible Member's request for long-term disability benefits are
denied;
b. The date the Eligible
Member no longer has leave with pay available; or
c. For an Eligible Member on long-term
disability who does not return to the same Employer or Transfer Employment, the
date long-term disability benefits are terminated.
