Ariz. Admin. Code § R20-5-625 - Failure to Abate a Violation for Which a Citation Has Been Issued
A. All employers
failing to abate an alleged violation for which a citation has been issued,
within the period permitted for its abatement, shall be notified of such
failure and any proposed penalties issued pursuant to A.R.S. §
23-418 by certified mail or by
signed verification in person.
B.
All notices to contest a notification of failure to abate a violation and of
proposed additional penalty shall be submitted to the Division Director and
immediately transmitted to the Office of Administrative Hearings in accordance
with the Rules of Procedure prescribed by the Industrial Commission.
C. Each notification of failure to abate a
violation and of proposed additional penalty shall state that it shall be
deemed to be the final order of the Industrial Commission and not subject to
review by any court or agency unless within fifteen working days from the
receipt of such notification, the employer notifies the Division Director in
writing of the intent to contest the notification or the proposed additional
penalty before the Office of Administrative Hearings.
