Ariz. Admin. Code § R21-1-308 - Hearings: Location; Notice; Time
A. The hearing shall be held by
OAH.
B. OAH may schedule a
telephonic hearing or permit a witness to appear telephonically as granted in
A.A.C.
R2-19-114.
C. After receiving a request for an appeal,
the Department shall hold the hearing:
1. For
a foster parent, 10 days after the Department receives the request for an
appeal under A.R.S. §
8-506;
2. For a Child Welfare Agency, 10 days after
the Department receives the request for an appeal under A.R.S. § 506.01;
and
3. The time listed in A.R.S.
§
41-1092.05(A)(2) for all other appeals.
D. The Department shall mail a notice of
hearing to all interested parties at least 20 days before the scheduled hearing
date, except where the hearing is held within the 10-day period specified in
subsection (C)(1) and (C)(2). For hearings held within the 10-day period, the
Department shall notify the parties by telephone and send a written notice at
the earliest date practicable.
E.
The notice of the hearing shall be in writing and shall include the information
required in A.R.S §
41-1092.05(D) and A.A.C.
