A. The Department
shall review an initial, renewal, or amendment application and render a
licensing decision within the required time-frames described in this
Section.
B. The administrative
completeness review time-frame described in A.R.S. §
41-1072(1) begins when the:
1. Applicant submits the
application, and
2. Required
documentation listed in this Chapter.
C. The Department shall complete an
administrative review within 45 calendar days of receiving the information in
subsection (B). The Department shall conduct an administrative completeness
review to determine whether all required documentation and information has been
submitted within the 45 calendar days administrative review time-frame:
1. If the application package is complete,
the Department shall send a Notice of Administrative Completeness to the
applicant and conduct the substantive review; or
2. If the application is incomplete, the
Department shall send a Notice of Incomplete Application to the applicant
containing a list of items and information needed to complete the application.
a. The applicant shall have 30 calendar days
from the date on the Notice of Incomplete Application to supply the missing
items or information to the Department.
b. The time-frame for the administrative
completeness review shall be suspended from the date the Department issues the
Notice of Incomplete Application to the date the Department receives the
missing item or information.
c. If
the applicant does not supply all of the requested items or information within
30 calendar days of the date of the Notice of Incomplete Application, the
Department may close the application.
d. If the applicant supplies all of the
required items and information to the Department within 30 calendar days, the
Department shall conduct a substantive review of the application.
D. Within 30 calendar
days following the conclusion of the administrative review of an application,
the Department shall complete a substantive review to evaluate the applicant's
fitness for licensure. Within the 30 calendar days substantive review
time-frame, the Department shall:
1. Conduct
inspections as described in
R21-7-105 ;
2. Complete a review of licensing
requirements under this Chapter; and
3. Request that the applicant provide
additional information if needed to evaluate the suitability of the applicant
for licensure.
a. The applicant shall have an
additional 30 calendar days from the date of the request, to provide the
information to the Department.
b.
The time-frame for the substantive review shall be suspended from the date the
Department requests additional information to the date the Department receives
the information.
E. Within an overall time-frame of 75
calendar days, not including suspended time-frames, the Department shall:
1. Complete an administrative review of an
application,
2. Complete a
substantive review of an applicant's fitness, and
3. Notify the applicant of the decision to
grant or deny the application.
