A. Vegetable
seed shall have the following minimum percent germination or the minimum
percent germination as found in the "Federal Seed Act,"7 C.F.R. §
201.31 (as amended July 7, 2020), which is
incorporated by reference, not including future editions or amendments. The

and percentage of hard seed. A mixture of kinds does not meet the germination
standard if the germination of any kind or combination of kinds constituting 25
percent or more of the mixture by number of seed is below the germination
standard for the kind or kinds involved.

D. A person shall not indicate a quality of
seed higher than the actual quality as found through germination
test.
E. The labeler or the person
who sells, offers, or exposes for sale within this state seeds in
hermetically-sealed containers more than 36 months after the last day of the
month in which the seeds were tested prior to packaging, shall retest the seeds
within nine months, excluding of the calendar month in which the retest was
completed, immediately prior to sale, exposure for sale, or offering for sale
or transportation.
