Ariz. Admin. Code § R3-8-407 - Joint Responsibility
A.
An applicator, qualifying party, branch supervisor, or business licensee who
supervises another person shall ensure that the supervised person is properly
trained and equipped and receives the supervision necessary for the supervised
person to provide pest management services in accordance with the pesticide
label and labeling, this Chapter and the PMD statutes.
B. An applicator, qualifying party, branch
supervisor, or business licensee who supervises another person may be held
jointly responsible for the acts or omissions of the supervised
person.
C. It is an affirmative
defense to joint responsibility as described in subsection (B) if an
applicator, qualifying party, branch supervisor, or business licensee complied
with subsection (A) and can demonstrate that compliance with contemporaneously
maintained records.
D. A QP and
business licensee shall comply with every provision in this Chapter regarding
applicator duties and responsibilities.
