Ariz. Admin. Code § R6-6-309 - Termination of Eligibility for the Program
A. Pursuant to A.R.S. §
36-566(A) and (B), the Department may terminate
eligibility following a 35-day written notice period to the member or the
responsible person when:
1. The Department
determines that the member no longer meets the conditions of eligibility for
services;
2. The member reaches the
age of 18, unless an application for eligibility has been filed with the
Department; or
3. The member fails
to comply with R6-6-308.
B. The 35-day written notice shall include
the proposed termination date and information regarding the opportunity for
administrative review under Article 18 of this Chapter.
C. The Department shall terminate the
member's eligibility for the program if the member or responsible person
provides a written request for withdrawal from the program.
