Ariz. Admin. Code § R7-2-1081 - Defective Cost or Pricing Data
A.
The school district may reduce the contract price if, upon determination, the
cost or pricing data are defective.
B. The contract price shall be reduced in the
amount of the defect plus related overhead and profit or fee if the school
district relied upon the defective data in awarding the contract.
C. Any dispute as to the existence of
defective cost or pricing data or the amount of an adjustment due to defective
cost or pricing data may be appealed as a contract controversy under
R7-2-1141 through
R7-2-1185 .
Pending appeal, the adjusted contract price shall remain in effect.
D. If certification of either current cost or
pricing data is required, the awarded contract shall include notice of the
right of the school district to a reduction in price if certified cost or
pricing data are subsequently determined to be defective.
