Ariz. Admin. Code § R9-19-209 - Cancellation of a Registered Birth Record
A. The State Registrar shall cancel an
individual's registered birth record if the State Registrar determines that:
1. Another registered birth record for the
individual exists and was registered before the individual's birth was
registered under this Article; or
2. The information submitted for registration
of the birth and creation of the registered birth record was fraudulent, a
misrepresentation of facts, or based on false documents.
B. If the State Registrar intends to cancel
an individual's registered birth record as prescribed in subsection (A), the
State Registrar shall provide written notice of the intent to cancel and the
right to appeal the intent to cancel, as prescribed in A.R.S. Title 41, Chapter
6, Article 6, to:
1. The individual, if the
individual is of legal age or is married; or
2. The individual's parent, if the individual
is not of legal age and is not married, or, if applicable, the individual's
guardian.
