A. A mental health agency may establish
policies and procedures for the provision of behavioral health services or
community services that are consistent with Articles 1 through 5 of these rules
and with all other requirements of Arizona law. No policy or procedure may
restrict any right protected by these rules.
B. The mental health agency shall inform all
prospective clients of its policies and procedures prior to the client or, if
applicable, the client's guardian giving informed consent to the client's
admission to the program according to R9-21-206.01(A)(3).
C. If a client acts in a manner that is
seriously in disregard of a reasonable policy, the agency director shall make
all reasonable efforts to respond to the situation, including making reasonable
accommodation to the program's policy if the client's failure to conform to a
reasonable policy is due to the client's disability.
