Ariz. Admin. Code § R9-7-107 - Misconduct
A. A licensee,
registrant, applicant for a license or certificate of registration, or employee
of a licensee, registrant, or applicant; or any contractor (including a
supplier or consultant), subcontractor, or employee of a contractor or
subcontractor of any licensee or certificate of registration holder who
provides to any licensee, registrant, applicant, contractor, or subcontractor,
any components, equipment, materials, or other goods or services that relate to
a licensee's, registrant's, or applicant's activities in this Chapter, shall
not:
1. Knowingly engage in conduct that
violates or will result in a violation by a licensee, registrant, or applicant,
of any statute, rule, regulation, or order; or any term, condition, or
limitation of any license or registration issued by the Department;
or
2. Knowingly submit to the
Department, or a licensee, registrant, or applicant, or a licensee's,
registrant's, or applicant's contractor or subcontractor, information that is
incomplete or inaccurate.
B. The Board shall impose the applicable
civil penalty listed in R9-7-1216 on a person who violates subsection (A)(1) or
(A)(2). For this purpose the person is classified as a Division II licensee and
the violation is classified as a Severity II violation.
C. For the purposes of this Section,
"misconduct" means conduct prohibited under subsection (A).
D. A person who is not a licensee,
registrant, or applicant and knowingly violates a rule for the safe use of
radiation sources in 9 A.A.C. 7 is subject to the enforcement actions in 9
A.A.C. 7, Article 12.
